Consent Management Tool: Cookie Handling in Swiss Data Protection Law

Post by ahnafhossen40 »

For years, Swiss business associations and media have been pointing out that companies should prepare for the implementation of the new data protection law. The new Data Protection Act (DSG) and its implementing provisions in the new Data Protection Ordinance (DSV) and the new Ordinance on Data Protection Certifications (VDSZ) will come into force in Switzerland on September 1, 2023. Switzerland will thus have a new law to better protect its population's data.

Consent Management ToolPrivate individuals are particularly protected
The new data protection law affects all companies, regardless of whether they operate in B2B or B2C . The new law no longer applies to data of legal entities. However, since data of natural persons (e.g. contact persons) is also regularly processed in B2B transactions, this does not have a major impact. In Switzerland, however, in contrast to the GDPR, the processing of personal data is only prohibited in exceptional cases. Under the GDPR, the European equivalent of the DSG, the processing of personal data is only permitted in exceptional cases. This is an eminently important difference.

Consent Management ToolManagement of consents hardly feasible without tools
Many people are annoyed by "cookie banners" that inform them about the setting of cookies. A consent management tool is an intelligent and automated solution that, in addition to displaying opt-in/opt-out, also enables the storage and management of consents and rejections. Such tools are not required by law, but without them, implementation of the law is difficult .

A Consent Management Tool (CMT) is also important to ensure that the processing of personal data is in line with the new data protection law and that users have given their consent for the processing of their data. It enables website operators to provide users with a clear and transparent explanation of what personal data is collected, how it is used and who has access to it.

A consent management tool can contain various functions, such as:

Displaying cookie banners and obtaining user consent to the use of cookies on the website.
Obtaining consent for the processing of personal data for specific Argentina Phone Number Resource purposes. This includes, for example, sending newsletters or displaying personalized advertising.
Managing consents and their revocation by the user.
Providing information about the processing of personal data and the privacy policy of the website.
Creating consent protocols and documentation for compliance and proof to regulators.

According to data protection law, every person has the right to know what data is stored about them and, if necessary, to have it deleted or corrected.

This so-called right to information makes it possible to retain control over one's own personal data. A consent management tool can also help to minimize the risk of violations of data protection laws. It ensures that data processing only takes place within the scope of the user's consent. A consent management tool is therefore an important tool for website operators to fulfill their obligations with regard to data protection and to strengthen users' trust in the processing of their personal data.

In particular, a consent management tool can help facilitate users' right to information by allowing website operators to keep a detailed record of which personal data has been processed by users and which consents they have given. This way, website operators can quickly and easily provide information about their personal data upon request from users.
